    This SMS & TCPA Compliance Policy outlines the requirements and responsibilities for businesses using the NXM AI platform to send SMS messages or automated communications. The policy is intended to ensure compliance with applicable laws governing electronic communications, including the Telephone Consumer Protection Act (TCPA) and related regulations.

    NXM AI provides automation tools that allow businesses to communicate with customers via SMS messaging and automated communications. However, the responsibility for lawful use of these tools rests with the platform user.

    2. Consent Requirements

    Users of the NXM AI platform must obtain prior express consent from individuals before sending automated SMS messages or marketing communications.

    Consent must meet the following standards:

    • The recipient must clearly agree to receive messages from the business.
    • Consent must be obtained before sending promotional or automated messages.
    • Consent must not be obtained through misleading or deceptive practices.
    • Consent records must be retained by the business.

    Examples of acceptable consent methods include:

    4. Opt-Out Mechanisms

    • Messaging individuals who have opted out

    NXM AI reserves the right to suspend or terminate accounts engaging in prohibited messaging practices.

    6. Recordkeeping

    Businesses are responsible for maintaining records demonstrating compliance with messaging laws, including:

    • Proof of consent
    • Message logs
    • Opt-out requests and responses

    NXM AI may maintain system logs for operational purposes but does not guarantee regulatory compliance on behalf of users.

    7. Compliance Responsibility

    While NXM AI provides communication tools and automation infrastructure, users remain solely responsible for ensuring their communications comply with applicable laws, including but not limited to:

    • Telephone Consumer Protection Act (TCPA)
    • CAN-SPAM Act
    • Federal Communications Commission (FCC) regulations
    • Applicable state consumer protection laws

    Businesses should consult legal counsel to ensure compliance with applicable messaging laws.

    8. Enforcement

    NXM AI reserves the right to suspend or terminate accounts that violate this policy or expose the platform to legal or regulatory risk.
